Presentation by Professor Oleksandr Biryukov at the conference ‘The Role of Commercial Courts in Ensuring the Effectiveness of Bankruptcy Proceedings’
Oleksandr BIRYUKOV, Doctor of Law, Professor of the Department of Private International Law of the Institute of International Relations of Taras Shevchenko National University of Kyiv, UNIDROIT Сorrespondent, Member of the World Bank Task Force on Effective Insolvency Systems, Member of CERIL took part in the conference "The Role of Commercial Courts in Ensuring the Efficiency of Bankruptcy Procedures", dedicated to the 35th anniversary of the establishment of the Commercial Courts in Ukraine, organized by the Supreme Court and held on March 13, 2026 in Uzhgorod.

The event was attended by judges, representatives of state authorities, the scientific and legal community, international experts, as well as representatives of the professional environment in the field of bankruptcy.
His report was devoted to international standards in the field of bankruptcy at the stage of opening bankruptcy proceedings.
In his speech, Oleksandr Biryukov cited international standards on admission to bankruptcy procedures and criteria for recognizing a debtor insolvent.
In conclusion, the speaker noted that Ukrainian bankruptcy legislation requires conceptual changes to return to a harmonious model. During the existence of the Bankruptcy Procedure Code, many changes have been made, a new procedure has appeared, and today two draft laws are being discussed that propose different models of another procedure. Such activity cannot but affect the change in the general concept, which is already reflected in judicial practice, in particular, the change in the legal positions of the courts.
